Terms of Service

These Terms of Service (“Terms”) govern your use of this site (the “Site”) and any reservations, services, or content made available by Ikoi Homes (“Ikoi,” “we,” “us,” or “our”). By using the Site or booking a stay, you agree to these Terms.

Eligibility

You must be at least 18 years old and legally able to enter into a binding contract to use the Site or book a stay. By booking, you represent that you meet these requirements and that the information you provide is accurate.

Reservations and Bookings

Reservation availability, pricing, and property details are provided through our property-management system. While we work to keep this information accurate, listings, prices, taxes, and fees may change without notice and may be corrected at any time before a booking is confirmed.

A reservation becomes binding only when you receive a confirmation from us. The person who books the reservation is the responsible party for the entire stay and for all guests listed on the reservation.

Payment

Payments are processed securely through Stripe. The payment terms shown at checkout, including any deposit and the schedule for the remaining balance, control your reservation.

You authorize us, and our payment processor acting on our behalf, to charge the payment method you provide for all amounts owed under your reservation, including any additional charges for damages, missing items, additional cleaning, or unauthorized guests as described in the house rules.

Cancellations, Changes, and Refunds

Each property's listed cancellation policy controls cancellations and refunds for that property and is shown before you book. Any changes to a confirmed reservation are subject to availability and to that policy. We may cancel a reservation, with a refund of amounts paid, if the property becomes unavailable due to circumstances outside our reasonable control.

House Rules and Guest Responsibilities

Each property has house rules covering items such as occupancy limits, quiet hours, pets, smoking, parking, and event restrictions. By booking, you agree to follow the house rules for the property you reserve and to ensure that everyone in your party does the same.

You agree to leave the property in the condition in which you found it (subject to normal wear and tear) and to promptly report any damage or maintenance issues. You are responsible for the conduct of all guests and visitors during your stay, including any damage caused by them.

Acceptable Use of the Site

You agree not to use the Site for any unlawful purpose, to attempt to gain unauthorized access to any portion of the Site or related systems, to interfere with the operation of the Site, to submit false or misleading information, or to scrape or copy content for commercial purposes without our written permission.

Intellectual Property

The Site and its content, including text, images, logos, and software, are owned by Ikoi or our licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Site for its intended purpose. All other rights are reserved.

Third-Party Services and Listings

Bookings are fulfilled with the assistance of third-party services including our property-management system and Stripe (payment processing). Some reservations may originate from third-party listing channels (such as Airbnb or Vrbo), each of which has its own terms and policies that apply alongside these Terms. We are not responsible for the terms, policies, or practices of any third party.

Disclaimers

The Site and our services are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted or error-free, or that information on the Site is complete or accurate at all times.

Limitation of Liability

To the fullest extent permitted by law, Ikoi and its officers, members, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Site or any reservation. Our total liability for any claim arising out of or relating to the Site or your reservation is limited to the amount you paid to us for the reservation giving rise to the claim.

Indemnification

You agree to indemnify, defend, and hold harmless Ikoi and its officers, members, employees, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your use of the Site, your reservation, your violation of these Terms, or your violation of any rights of another.

Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. You and Ikoi agree that the exclusive jurisdiction and venue for any dispute arising out of or relating to these Terms or the Site will be the state and federal courts located in California, and you consent to the personal jurisdiction of those courts.

Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the Effective Date above. Continued use of the Site after changes take effect constitutes your acceptance of the updated Terms.
